These Terms and Conditions (“T&Cs”) apply as soon as a service is booked. By completing a booking for any of the services provided by Clean & Kind GmbH (“Clean & Kind”), the client agrees to these T&Cs.

1. GENERAL CONDITIONS

1.1 Clean & Kind undertakes to keep the dog in a species-appropriate manner and to comply with the Swiss Animal Welfare Act (Tierschutzgesetz, TSchG) and its related provisions.

1.2 All dogs must be vaccinated, microchipped, registered with AMICUS, and fully healthy. If the dog is ill or shows behavioural problems, the owner must notify Clean & Kind prior to the appointment. This also applies in the case of a female dog in heat.

​

1.3 The dog must be up to date with the following vaccinations: Rabies, Distemper, Hepatitis, Leptospirosis, Parvovirus, and Kennel Cough. The dog must also be regularly and effectively dewormed and flea-free.

​

1.4 Clean & Kind GmbH reserves the right to refuse entry for any dog that shows symptoms of illness not previously disclosed, including where, in our reasonable opinion, the illness was not sufficiently described at the time of booking. In such cases, the fee for the service will be charged in accordance with the late cancellation / no-show policy (see Section 5).

1.5 To ensure a safe environment, all dogs must be leashed in the parking lot, inside the TCM Center building, and in the Clean & Kind entrance area. Owners are obliged to pick up their dog’s waste in these areas.

​

1.6 The dog owner is obliged to pick up the dog at the agreed time. If the dog is not picked up on time, additional costs will be charged to the dog owner in accordance with the applicable service-specific rules set out below.

​

1.7 The dog owner authorises Clean & Kind to take the dog to a veterinarian when necessary, and in case of emergency, to contact the veterinarian before the owner. The owner will be contacted as soon as possible thereafter. The costs of the veterinary visit will be charged to the dog owner.

​

1.8 Clean & Kind reserves the right to separate or muzzle the dog if necessary for its safety, or for the safety of other clients and staff, without prior consultation with the dog owner.

2. ADDITIONAL Daycare RULES

2.1 An initial meeting is required for irregular daycare bookings. A successful trial day is required before any subscription or boarding arrangement can begin.

2.2 Further daycare bookings are only confirmed after a successful trial day assessment.

​

2.3 Puppies must be at least 12 weeks old and comfortable in a social environment.

​

2.4 Female dogs in heat are not permitted in the daycare.

​

2.5 In the case of aggressive or disruptive behaviour, Clean & Kind reserves the right to refuse uncastrated male dogs in the daycare.

​

2.6 Drop-off times are 07:45–08:10 and pick-up times are 17:45–18:10. Owners are expected to respect these times.

​

2.7 The dog owner is obliged to pick up the dog within the agreed pick-up period. Pick-up more than 10 minutes after the end of the pick-up period will be charged at CHF 10 per 15 minutes.

​

2.8 No battery-operated devices such as GPS trackers or lights on collars are allowed in the Clean & Kind daycare for safety reasons.

​

2.9 Food for daycare and boarding must be provided by the dog owner; otherwise, an additional food cost will be invoiced. The dog owner must also provide all required medications. Veterinary or pharmacy visits necessitated by missing medication will be charged to the owner.

3. ADDITIONAL grooming RULES

3.1 The dog owner must share with Clean & Kind all necessary information about the pet’s conditions (e.g. allergies, illnesses, behavioural disorders, etc.).

3.2 Requests that could endanger the dog’s well-being will not be carried out.

​

3.3 The maximum duration of a grooming session at Clean & Kind is 3 hours, to ensure the animal’s well-being. In cases involving distressed animals or dogs with health conditions (e.g. senior dogs with rheumatism, breeds prone to overheating, etc.), we reserve the right to shorten the appointment and schedule a follow-up within a reasonable timeframe.

​

3.4 If the treatment is prematurely terminated due to an unexpected health or hygiene finding (e.g. fleas, skin infection), the dog’s behaviour (e.g. biting, seizures, overwhelming discomfort), or the owner acting contrary to instructions from Clean & Kind GmbH grooming staff, the grooming service based on the hourly rate must still be paid in full.

3.5 The dog must be checked by the owner immediately after grooming for any treatment defects, which can then be corrected on the spot. Later complaints cannot be accepted. The price of the original treatment based on the hourly rate must be paid.

​

3.6 The dog owner is obliged to pick up the dog at the agreed time. The owner will be given an approximate pick-up time during the initial consultation. If the dog is ready earlier, the owner will be contacted at least 30 minutes before the groom is finished. The dog should be picked up no later than 30 minutes after the groom is finished. An additional fee of CHF 10 per 15 minutes will be charged thereafter.

4. PHOTO AND VIDEO CONSENT

4.1 By using Clean & Kind GmbH’s services, the owner consents to the use of photos and videos of their dog taken during service provision for promotional and/or documentation purposes.

​

4.2 The owner may withdraw this consent at any time by notifying Clean & Kind in writing. Upon receipt of such notice, Clean & Kind will cease using any new images of the owner’s dog, though removal of previously published material cannot be guaranteed where technically impracticable.

Cancellation policy

5. cancellation policy

5.1 Grooming

5.1.1 Appointments must be cancelled with at least 24 hours’ notice.

​

5.1.2 Cancellations made within 8–24 hours of the appointment will be charged at 50% of the estimated grooming price. Cancellations made less than 8 hours before the appointment, and no-shows, will be charged at 100% of the estimated price.

5.2 Daycare

5.2.1 Subscription (“Amazing ABO”) cancellations require at least one month’s notice, effective from the first day of the following month. The minimum subscription period is 3 months. If the subscription is cancelled before the minimum period has elapsed, the difference between the subscription rate and the standard non-subscription daily rate will be charged additionally.

5.2.2 Non-regular daycare cancellations made within 3 days of the service date will be charged at 100%. No-shows will be charged 100%.

5.3 boarding

5.3.1 Clients must cancel boarding at least 10 days in advance. Cancellations made less than 10 days but more than 5 days before the service will be charged at 25% of the booked service cost. Cancellations made 5 days or fewer before the service will be charged at 50%.

5.4 events

Events must be cancelled with at least 24 hours’ notice. Cancellations made within 8–24 hours will be charged at 50% of the event price. Cancellations made less than 8 hours before the event, and no-shows, will be charged at 100% of the price.

Payments

6. Payments

6.1 Subscription invoices are sent on the 10th of each month. Additional services are invoiced separately at month-end.

​

6.2 Payment for non-subscription services such as grooming, events, and one-time daycare is due by card or cash upon collection.

​

6.3 In the event of late payment, Clean & Kind GmbH reserves the right to charge default interest in accordance with Art. 104 of the Swiss Code of Obligations (OR) at 5% per annum, following a written reminder.

​

6.4 Prices of all services are inclusive of VAT.

Subscribtion

7. Subscribtion

7.1 Subscriptions (“Amazing ABO”) are available for regular daycare clients. The specific days, frequency, and pricing are agreed upon at the time of subscription.

​

7.2 The minimum subscription period is 3 months from the start date.

​

7.3 Changes to the subscription (e.g. adding or removing days) must be requested in writing at least one month in advance, effective from the first day of the following month.

​

7.4 Subscription applies only on the weekdays that are working days. This does not include public holidays.  

​

7.5 Subscription fees are non-refundable for unused days, except in the case of illness or injury of the dog, supported by a veterinary certificate, in which case a credit may be applied at Clean & Kind’s discretion.

​

7.6 The cost of subscription is calculated for 48 weeks. Each month the customer pays 4 weeks, regardless of the length of the month. This way, the Clean&Kind ensures 4 weeks of annual vacation for its staff.

Insurance and liability

8. insurance and liability

8.1 General

Clean & Kind GmbH accepts no responsibility for loss of or damage to items belonging to the owner, such as dog beds, bowls, toys, or blankets.

If the dog owner violates or disregards these T&Cs or instructions given by Clean & Kind GmbH, Clean & Kind GmbH’s liability is excluded to the fullest extent permitted by law.

​

8.2 Liability in Case of Damage

Clean & Kind GmbH is liable to the client or third parties only for damages caused during contract fulfilment due to a demonstrable breach of its duty of care, and exclusively within the scope of its business liability insurance. If the client has not provided adequate information or instructions, Clean & Kind GmbH rejects any resulting liability claims in full.

8.2.1 No compensation shall be granted for injuries to or loss of the animal (including infectious diseases, escape, etc.) arising from unforeseeable accidents for which Clean & Kind GmbH is not at fault.

​

8.2.2 The dog owner is liable for any damage caused by their dog to Clean & Kind GmbH’s property, other dogs, or third parties in accordance with Art. 56 of the Swiss Code of Obligations (OR) (liability of animal keepers).

Data protection

9. data protection

9.1 Clean & Kind GmbH processes personal data of dog owners (such as name, address, telephone number, email address, and information about their dogs) for the purpose of providing and administering its services.

9.2 Data processing is carried out in accordance with the Swiss Federal Act on Data Protection (nDSG/FADP) and any applicable cantonal regulations.

​

9.3 Personal data will not be disclosed to third parties, except where required by law or necessary for the performance of the contract (e.g. veterinary emergencies).

​

9.4 The dog owner has the right to request information about, correction of, or deletion of their personal data at any time by contacting Clean & Kind GmbH in writing

10. FORCE MAJEURE

10.1 Clean & Kind GmbH shall not be held liable for the non-performance or delayed performance of its obligations to the extent that such non-performance or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, government orders, or disruption of essential utilities

11. severability

11.1 Should any provision of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original provision.

12. jurisdiction

12.1 These T&Cs and any disputes arising out of or in connection with the services provided by Clean & Kind GmbH shall be governed exclusively by Swiss law.

12.2 The exclusive place of jurisdiction for all disputes is Zurich, Switzerland, subject to any mandatory statutory provisions to the contrary.
